A man has appeared before Highbury Corner Magistrates’ Court this morning after being charged with driving under the influence of alcohol.
Joseph Clail, 32, from Kingsbury Road, London pleaded guilty to the charge after he was pulled over by the police after allegedly driving a BMW erratically at around 2:30am on the 31stMarch.
After admitting at the scene that he had been drinking, Clail was then requested by police to take a breathalyser test which confirmed he had exceeded the legal driving limit.
The prosecution stated that the defendant has had previous convictions from 2007 but has not had any altercations with the law since.
His defence stated in court that: “It is a stupid mistake he’s made and he admits that.”
His defence then asked the court that Mr Clail be given the benefit of the doubt considering that he had been following a drink driving awareness course and requested that he be given the minimum amount of suspension of his license as he needs to be mobile for his job.
After hearing all that had to be said, the magistrate showed recognition towards the defendant stating: “I give you credit for pleading guilty and following along with the programme.”
The court issued a 12-month driving ban however, if Mr Clail continues on the drink drivers’ programme this would be reduced to nine months along with a £580 fine that he is required to pay in instalments every fortnight.
